Wave Engine Game Developer Contest 2016 (the "Contest") is open only to individuals who (i) are not residents of Cuba, Iran, North Korea, Sudan or Syria, (ii) reside in countries where the Windows Store is available, (iii) are at least eighteen (18) years old, (iv) did not purchase any products, services or equipment for the purposes of entering this Contest, and (v) are registered Plain Concepts developers at the time entry. Employees of Plain Concepts, S.L. and Plain Concepts Corporation ("Plain Concepts"), and any of their respective related companies, parents, subsidiaries, affiliates, and agents and any agencies or other companies involved in the development or execution of the Contest or production or distribution of Contest materials, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.
The purpose of this Contest is for entrants to submit their original games ("Games") that are built using Plain Concepts’ Wave Engine platform and are published to the Windows Store. Entrants may submit a new original game or port an existing published app (from an alternative platform like Android, iOS, Amazon Kindle, Blackberry, etc.) and thereby make it compatible for the Windows platform. A panel of Plain Concepts judges will select the Contest winners, in accordance with the winner selection criteria set forth below.

Participation in this Contest constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor's and Administrator’s decisions, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
The Contest begins on 1 May 2016 at 00:00 Coordinated Universal Time ("UTC") and ends on 31 October 2016 at 23:59 UTC (the "Contest Period").
You must have an active Windows Developer account ("Account") to participate. If you don't have one, visit https://waveengine.net/Contests and follow the instructions to complete and submit the registration form including your name and email address. Sponsor will email a token and instructions on how to register for a free Account that you may use to enter this Contest.
During the Contest Period, take the following actions to enter the Contest:
A. Create or Port your original Game:
Create or port using the Development Tools (as defined below) an original Game that is playable on Windows 10 (UWP). Then, submit your Game to the Windows Store to be published. The Windows 10 Store has specific instructions that can be found at https://dev.windows.com. Please allow sufficient time for your Game to be reviewed and certified through the Windows 10 Store process, before it is published and live on the Windows 10 Store. The time required for the process will vary and could be lengthy. To be eligible, your Game must be submitted to the Windows 10 Store on or after 1 May 2016 (00:00 UTC) and must be live on the Windows 10 Store no later than 31 October 2016 (23:59 UTC).
B. Register your Contest Entry:
Once your Game is published in the Windows 10 Store and during the Contest Period, visit https://waveengine.net/Contests and follow the links and instructions to complete and submit the registration form including your full name, email address, a link to your published Game in the Windows 10 Store. The registration form and your published Game are collectively referred to as your "Submission".

The above will be referred to in these Official Rules as the “Development Tools.” The use of all Development Tools is free.
D. Technical Requirements for your Submission:
Games intended for the Windows Platform must be certified and live on the Windows 10 (UWP) Store and run on Windows 10.
E. Content Restrictions for your Submission:
By uploading your Submission, you agree that it conforms to the Technical Requirements and Content Restrictions as defined above and that Sponsor may disqualify you from the Contest if it believes, in its sole discretion that your Submission fails to conform to these Technical Requirements or Content Restrictions.
Limit: Each entrant may enter the Contest ten (10) times during the Contest Period. Each Submission you submit must be substantially unique and different. Closely similar Submissions that have minor changes (i.e., color, language) but have been submitted as separate Submissions will be disqualified and only the first Submission submitted under that Submission type will be eligible. Submissions received from any person or email address in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void. Released Parties (as defined in Section 9, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions, all of which will be void. Uploading a Submission constitutes entrant’s consent to give Sponsor and its Contest partner, Sponsor, a royalty-free, non-exclusive license to use, review, assess, test and otherwise analyze your Submission and all its content in connection with this Contest; and (ii) feature your Submission and all content in connection with the marketing, sale, or promotion of this Contest (including but not limited to internal and external sales meetings, conference presentations, tradeshows, and screen shots of the Contest entry in press releases) in all media (now known or later developed). Entrant will retain ownership rights of his or her Submission.
In the event of a dispute regarding any Submission, the authorized account holder of the email address used to register will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being an authorized account holder.
After the conclusion of the Contest Period, a panel of qualified judges including representatives of the Sponsor and the Administrator in their sole discretion will select the four (4) highest scoring Submissions (First Prize, Second Prize, Third prize and Fourth prize winners) from among all eligible Submissions received, based on an application of the following criteria (“Judging Criteria”):
In the event of a tie at any prize level, the entrant whose Submission received the higher score in the "Quality of Submission" category, as determined by the judges at their sole discretion, will be deemed the potential applicable winner.
Sponsor reserves the right to select fewer than the stated number of winners if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.
Potential winners will be notified by email on or around 15 November 2016. Except where prohibited, each potential winner (parent/legal guardian if a winner is a minor in his/her place of residence) may be required to sign and return a Declaration of Compliance, Liability and Publicity Release ("Declaration"), which must be received by Administrator within five (5) days of the date that notice is sent, in order to claim his/her prize. Non-U.S. winners will also be required to complete a W8-BEN form. If a potential winner cannot be contacted, fails to sign and return the Declaration, or does not comply with these Official Rules, potential winner forfeits the prize. If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up determined by the qualified judges, in Sponsor's sole discretion. Only three (3) alternate winners may be determined, after which the applicable prize will remain un-awarded.
Acceptance of any prize shall constitute and signify each winner’s agreement and consent that Sponsor and its designees may use the winner’s name, city, state, likeness, Submission and/or prize information in connection with the Contest for promotional, advertising or other purposes, worldwide in any and all media now known or hereafter invented, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.
Prizes will be fulfilled approximately 8 – 10 weeks after the conclusion of the Contest.
FIRST PRIZE :$15,000 USD.
SECOND PRIZE :$8,000 USD.
THIRD PRIZE :$5,000 USD.
FOURTH PRIZE : $2,000 USD.
You are solely responsible for complying with all applicable tax laws and filing requirements. To remain eligible for a prize, you must submit to Plain Concepts or the relevant tax authority all documentation requested by Plain Concepts or required by applicable law within seven (7) days of Plain Concepts’ request or earlier if required by law.
You are solely responsible for paying all taxes imposed on prizes awarded to you. All prizes will be net of any taxes Plain Concepts is required by law to withhold.
Ownership of the pre-existing underlying intellectual property of the entrant remains the property of the entrant subject to Plain Concepts’ rights to (i) use, review, assess, test, and otherwise analyze entrant’s registration and all its content in connection with this contest; and (ii) feature entrant’s registration and all its content in connection with the marketing, sale, or promotion of this contest (including but not limited to internal and external presentations, tradeshows, and screen shots of the contest in press releases) in all media (now known or later developed). Each entrant hereby warrants that any registration and other materials and information provided by entrant are original with entrant and do not violate or infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity, and do not violate any rules or regulations. If the registration or information or materials provided by entrant contain any material or elements that are not owned by entrant and/or which are subject to the rights of third parties, entrant represents he or she has obtained, prior to submission of the registration and information or materials, any and all releases and consents necessary to permit use and exploitation of the registration and information and materials by Plain Concepts in the manner set forth in these Official Rules without additional compensation.
Each entrant warrants that the registration and materials and information provided do not contain information considered by entrant, its employees or personnel, or any other third party to be confidential, and that the registration, materials and information provided do not violate any laws or regulations. Entrant agrees that Plain Concepts has the right to verify the ownership and originality of all registrations and that, upon Plain Concepts’ request, entrant must submit a written copy of any release or permission entrant has received from a third party granting entrant the right to use such property. Entrant understands and acknowledges that in the event a submission is selected as a winning registration, and entrant’ ownership, rights and the originality of the registration cannot be verified to the satisfaction of Plain Concepts or is in any other way ineligible, Plain Concepts may select an alternate winner based on the same judging criteria.
By participating in the contest, entrants:
By receipt of any prize, the applicable winner agrees to release and hold harmless Sponsor, Administrator, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize. Released Parties are not responsible for lost, late, damaged, misdirected, illegible, incomplete, or mutilated entries, or for any computer, online, telephone or technical malfunctions, delays or human errors that occur in the processing, transmission or receipt of entries, or for inaccurate transcription of entry information, or for entries that are stolen, misdirected, garbled, lost or delayed by computer transmissions, or if for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Plain Concepts. In no event will the Released Parties be responsible or liable for indirect, incidental, consequential, or punitive damages arising out of this contest, participation in the contest or prize activities or elements thereof, including but not limited to the submission of a registration, entrant’ access to and use of the promotional website or the uploading of materials to the website, and/or the delivery, acceptance and/or use/misuse of a prize. Plain Concepts reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest. Plain Concepts is not responsible for incorrect or inaccurate entry information whether caused by internet users or by any of the equipment or programming associated with or utilized in the contest or by any technical or human error that may occur in the processing of the entries in the contest.
Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Submission.
Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the appropriate Washington State Court located in King County, Seattle; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Washington without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.
